The subject of the article is the hardship clause, a mechanism adopted by the parties to an international commercial contract to address emerging conditions that may disrupt the balance of the contract. By including such a clause, they ensure the continuity of the contract and its proper functioning. On this basis, the extent to which the effective renegotiation mechanism adopted in international commercial contracts is problematic in responding to urgent conditions and restoring contractual balance is examined.
